1. Who this agreement is between
This agreement is between Mandarin Temple (“we”, “us”) and the school, or the tutor on a paid teaching seat, who accepts it (“you”). You are asked to accept it in the product when one of your circles has a learner under 16 in it, and acceptance is recorded once per version: who accepted, for which school if any, on which version and when.
It works alongside our Terms of Service and Privacy Policy. Where they differ about how we handle the data of learners in your circles, this agreement applies to that data.
2. Who decides what
You decide which learners are in your circles, and you are responsible for having a lawful basis for that — including, for every learner under 16, the agreement of a parent or guardian. For the data that exists because you run a circle, you are the controller and we process it on your behalf, under this agreement.
Each learner’s own account stays theirs. Their study record, settings, subscription and the Learning Lab estimates worked out from their answers are ours to run for them, under our Privacy Policy. A learner who leaves your circle keeps their account, and you stop seeing it.
We do not check anyone’s age or identity for you. When you confirm guardian consent for a circle, that is your promise, and it is recorded as yours. It is not an age check, and nothing in this agreement makes it one.
3. What we process on your behalf
The learners in your circles, and the people you invite to them. For them, we process:
- Membership — the name each learner shows, when they joined and whether they are still active.
- Invitations — the email addresses you enter to invite someone, and whether they accepted.
- What happens in the circle — chat messages and posts, what learners add to a shared board in a live lesson, the events you schedule, and the homework you set and whether it is done.
- Progress you can see — the summaries shown to you for learners actively enrolled in a circle you teach. Never the text a learner typed into an exercise, and never the results of the optional cognitive tasks.
- Whether a member is under 16 — worked out from the date of birth they gave, or from a parent or guardian managing their account, so that the protections in section 5 apply.
- Safeguarding records — your guardian-consent confirmations, and reports made about the circle.
We use this only to run the circle features you use, to keep learners safe, and to meet our legal obligations. We never sell it, and we never use it for advertising.
4. What we promise
- To act on your instructions — the ones you give by using the product: who is in a circle, what you set, and what you turn on or off.
- To keep it confidential. Our staff reach a learner’s data only where running the service requires it: a support request, a safety concern, or a study the learner has joined.
- To keep it secure — encrypted between the browser and our servers (TLS 1.3) and when stored, with passwords kept only as hashes, sessions anyone can end from their account, and regular security reviews.
- To tell you without undue delay if we become aware of a personal data breach affecting learners in your circles, with what we know and what we are doing about it.
- To help you answer requests from learners and parents. Learners can download and delete their own data from their account; for anything else, write to us and we will help.
- To show you how we meet this agreement when you ask — send us your questions or questionnaire.
5. What does not change, whoever is responsible
Accepting this agreement and confirming guardian consent unlocks features, such as chat, for a circle with under-16s in it. It never relaxes these, which apply to every circle with a child in it:
- messages, posts and comments are checked automatically before they appear, and if the check cannot run, the message is held back rather than let through;
- anyone can report a message or a member, and a report reaches a person;
- you can lock a circle’s conversation at any time, and what was said stays readable;
- a circle with a child in it cannot be opened up to the public;
- the retention periods in section 8 still apply.
6. Services we use
We use these services to run the platform. Each one processes learners’ data only to provide its part of the service:
- Amazon Web Services — hosting, databases, file storage and content delivery, in Singapore.
- OpenAI — the AI features, and the automatic checks on messages and posts described in section 5.
- ElevenLabs — turning text into speech, including Jason’s spoken replies to a learner.
- Resend — sending email, such as circle invitations and notifications.
- Sentry — error reports from the browser: the page address and the browser type, with no account identity.
We will update this list before a new service starts processing learners’ data. A material change raises this agreement’s version, which asks you to accept it again.
7. Where the data goes
Data is hosted in Singapore. Some of the services above process it elsewhere, including the United States, under Standard Contractual Clauses or an equivalent safeguard, as our Privacy Policy describes.
8. How long we keep it
- Circle chat is kept for 30 days, then deleted.
- Votes in a live board poll are kept for 90 days, and raised hands for a day.
- When a learner leaves a circle or you remove them, you stop seeing their progress. Their account and its data stay theirs.
- When a learner deletes their account, their personal data is removed within 30 days.
9. The records we keep about this agreement
- For each acceptance: who accepted, for which school if any, which version, when, and from which network address.
- For each guardian-consent confirmation: the circle, who confirmed, when, under which version, and how many under-16s it covered. Confirming again adds a new record; nothing is overwritten.
- A confirmation stops counting when a learner under 16 joins the circle after it, or when this agreement’s version changes. The circle then asks again.
10. Changes to this agreement
When this text changes materially, its version changes and you are asked to accept again. Until you do, the features that need it — such as chat in a circle with under-16s — pause for your circles. Nothing you or your learners have made is deleted.
